3. How We Use Your Information

We use the information we collect to:

• Build, configure, and maintain your AI voice agent
• Send you call summaries, lead notifications, and monthly reports

• Comply with legal obligations

We do not use your data for advertising purposes. We do not sell your data to third parties.

4. Call Recording & Caller Data

Your AI voice agent may record and transcribe calls in order to deliver lead summaries and call logs to you. By using our service, you are responsible for ensuring that your callers are notified of call recording in accordance with the laws applicable in your jurisdiction (e.g. two-party consent states in the US).

Caller data — including phone numbers and any information shared during calls — is stored securely and shared only with you (the business owner). We do not contact your callers directly or use their data for any purpose beyond delivering your agreed service.

If you are a caller whose data was captured through an agent we built, you may contact us at [email protected] to request access to or deletion of your data.

5. Third-Party Services We Use

To deliver our service, we use third-party tools including AI voice platforms, call routing providers, workflow automation tools, scheduling software, and cloud storage. We only share the minimum data necessary with these providers for your service to function. Each provider is governed by their own privacy policy and data processing terms.

6. Data Retention

We retain your data for as long as your account is active. Call recordings and transcripts are retained for 90 days by default unless you request a different arrangement in writing.

If you cancel your service, we will delete your business data (scripts, FAQs, configurations, call logs) within 30 days of receiving a written deletion request. We may retain minimal records as required by applicable law or legitimate business purposes (e.g. billing records).

7. Your Rights

California residents (CCPA): You have the right to know what personal data we collect, request deletion of your data, and opt out of any sale of your data (we do not sell data). To exercise these rights, contact us at the email above.

EEA/UK residents (GDPR): If you are located in the European Economic Area or United Kingdom, you have additional rights including the right to data portability and the right to lodge a complaint with your local supervisory authority. By visiting our website, booking a demo, or engaging The Boring Agency for any service, you acknowledge that you have read, understood, and agree to these Terms of Service. If you do not agree, please discontinue use of our website and services.

1. Agreement

By engaging The Boring Agency (“we”, “us”, “our”) for any service — including demos, onboarding, agent builds, or ongoing subscriptions — you (“Client”, “you”) agree to these Terms of Service. You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of your business.

2. Services

The Boring Agency provides AI voice agent setup, configuration, and management services for local service businesses. This includes building and configuring your AI voice agent, connecting your agent to your business phone number, delivering call summaries and reports, and ongoing agent updates per your subscription plan.

3. Payment Terms

• Setup fee: 50% due upon project commencement. Remaining 50% due upon delivery of agent credentials and go-live confirmation.
• Monthly subscription: Billed monthly in advance on the same date each month.
• Late payments: Accounts more than 7 days overdue may result in service suspension without further notice.
• Chargebacks: You agree not to initiate chargebacks for work that has been delivered and approved. Billing disputes must be raised in writing within 7 days of the relevant charge.

All prices are in USD unless otherwise agreed in writing. Setup fees are non-refundable once work has commenced. No refunds are issued for the current billing period upon cancellation.

4. Client Responsibilities

You agree to:

• Provide accurate and complete business information during onboarding
• Respond to review requests and communications within 10 business days
• Notify callers of call recording where required by applicable law
• Use the agent only for lawful business purposes
• Notify us promptly of any material changes to your business that may affect agent accuracy

5. Intellectual Property

Once your setup fee is fully paid, you own the agent configuration, scripts, and credentials delivered to you. The Boring Agency retains ownership of internal tools, templates, methodologies, and proprietary systems used to build your agent. You may not resell or sublicense the agent configuration to any third party without our prior written consent.

6. Call Recording Compliance

You are solely responsible for ensuring your use of an AI voice agent complies with applicable laws in your jurisdiction, including laws relating to call recording consent, automated calling systems, and AI disclosure requirements. The Boring Agency is not liable for any legal action, fines, or penalties arising from your non-compliant use of the service. We recommend consulting a qualified attorney regarding your specific compliance obligations before deploying the agent.

7. Cancellation & Termination

• By you: Cancel at any time with 14 days’ written notice to [email protected]. No refunds for the current billing period.
• By us: We may terminate with 14 days’ notice for any reason, or immediately for material breach (including non-payment beyond 14 days, unlawful use, or abusive conduct).
• Upon termination: Agent credentials delivered to you within 7 business days. All confidentiality obligations survive termination.

8. Disclaimer of Warranties

The Boring Agency warrants only that it will perform services in a professional manner. This is the sole warranty provided.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. THE BORING AGENCY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC BUSINESS OUTCOME WILL BE ACHIEVED.

9. Limitation of Liability

THE BORING AGENCY DOES NOT GUARANTEE SPECIFIC BUSINESS OUTCOMES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IN ANY DISPUTE IS LIMITED TO THE LESSER OF: (A) FEES ACTUALLY PAID IN THE 30 DAYS PRECEDING THE CLAIM, OR (B) USD $500. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND.

We are not liable for interruptions caused by third-party platforms or events outside our reasonable control. No individual owner, employee, or contractor of The Boring Agency has any personal liability to you under these terms.

10. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement — including scripts, pricing, call data, and business strategies. This obligation survives termination of this agreement.

11. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. In the event of any dispute, the parties will first attempt resolution through good-faith negotiation for 30 days. If unresolved, disputes shall be submitted to binding arbitration under AAA rules, seated in Delaware, conducted remotely. Any claim must be brought within 6 months of the date the claimant became aware of the relevant event. Claims not brought within this period are permanently barred.

12. Severability

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Changes to These Terms

We will notify active clients by email at least 14 days before material changes to these Terms take effect. Minor clarifications may be posted without prior notice. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
